Terms of Service

AlaKart Design Co., LLC is a creative design company providing branding solutions including but not limited to print and digital design and/or advertising, website design, social media design, email marketing automation and campaign/lead management.

Below is AlaKart Design Co., LLC standard Terms and Conditions.

Please take time to read through our Terms and Conditions thoroughly and ensure you understand them before you commence a project with us. By requesting designs and/or services from AlaKart Design Co., LLC  “Service Provider”, you are now “the client”, you agree to our Terms of Service, and you are aware that you are entering a binding contract – payment is required.

These Terms of Service are hereby effective on October 6, 2022 and will apply to the website that you are visiting, www.alakartdesignco.com (the “Website”), which is owned by AlaKart design Co., LLC. (the “Company” and “Service Provider”).

The price for the project will vary and be determined by a mutual agreement between the Service Provider and the client. These projects can be until completion or ongoing depending on the specific agreement of services between the company and the client. 50% deposit is non-refundable and must be paid one week after proposal in order to save your spot. Full payment must be made before the project can begin, unless the Service Provider and the client have entered into a payment plan. Payments must be made from the client to the Service Provider by one of the following payment methods: debit/credit card or Quickbooks invoice. The Service Provider will not transfer the project to the client’s control until the final payment is processed. 

Client Information Request

The client will be responsible for supplying all but not limited to the images, fonts, colors, testimonials, product descriptions, services, contact information, requested by the Service Provider. The client also agrees all provides materials do not break any known copyright laws.

Design Application

The client is responsible to submit a design application at www.alakartdesignco.com/contact, upon which the Service Provider will assess and determine the client’s requests are a good fit for services. The client will receive email correspondence whether the Service Provider will provide services. If the Service provider agrees to services, the Service Provider will begin the initial  proposal. Once the proposal for services has been delivered to the client via email, the client has one (1) week to agree and pay in full, or at minimum a 50% deposit, to hold their spot.  

Project Changes & Additions

Depending on the project, some projects may be built to completion or ongoing. An example of a completed project includes but is not limited to a Branding Suite. An ongoing project includes but is not limited to Communications services. Requesting changes/additions to any project must be mutually agreed by both the client and Service Provider. The client must read the specific requests for changes included on each services page {ie. Branding Suite, Communications, and/or Website Design} at www.alakartdesignco.com, as the maximum amount of changes based on each service type varies. Additional fees may apply for additional changes. The Service Provider has the right to refuse any additional revisions after the project has been completed. If the client makes or attempts to make any changes to the project and causes any issue to occur, the Service Provider will not be held liable. 

Other Project Expenses

The client shall reimburse the Service Provider for expenses incurred outside of the original project proposal including but not limited to:

  • Specially requested stock photography from sources other than our stock photo provider.
  • Specially requested fonts not in our existing library.
  • Specially requested website capabilities/programming that may require custom programming or a pro-version of a plugin.

 

Project Abandonment / Failure to Communicate

If the project has begun and the Service Provider cannot get in contact with the client via phone, text, or email after fourteen (14) days of project initiation, will stop the client’s project. If a client refuses communication and/or requests cancellation, ownership of all copyrights and original artwork shall be retained by the Service Provider, and any payments made are retained by the Service Provider. If a project is paid in full by the client, the client will be sent all artwork/project materials that were completed by the Service Provider.

Privacy & Security

The Service Provider agrees it will not reveal any sensitive or private information provided for the completion of the project. The Service Provider agrees it won’t share any usernames, passwords, codes, or any other private credentials related to the project at any time.

Topic Limitations

The Service Provider will not design, build, create, or start a project or add content to a project regarding the topics of religious beliefs, political views, sexual orientation, ethnicity & race, pornography, nudity or any other topic the Service Provider decides to avoid.

Liability 

If the client makes or attempts to make any changes to the project and causes any issue to occur, the Service Provider will not be held liable. Once the project is completed and is given to the client, the Service Provider will not be liable for any issues that occur to the project from that point forward. The Service Provider is not responsible for the Google ranking of the project, the amount of traffic to the project, or the amount of sales generated from the project. The Service Provider is only responsible for the initial design and development of the project. 

Final Statements

Once the client makes the initial deposit for services to the Service Provider the client agrees to the statements made in this Terms of Service and this agreement is in effect immediately.
